1. Acceptance of these Terms
These Terms & Conditions (“Terms”) are between Porters Potties LLC, doing business as Porter’s Potties (“Porter’s Potties,” “we,” “us,” or “our”), and the person or entity using our website or requesting services (“you” or “customer”). By using this website, submitting a quote request, or ordering services from us, you agree to these Terms to the extent applicable.
If you enter into a separate written quote, order confirmation, service agreement, or rental agreement with Porter’s Potties, that document controls over these website Terms if there is a conflict.
2. Quote requests, availability, and orders
Submitting a website form does not create a rental contract and does not guarantee equipment, delivery, service, or pricing. A request becomes an order only after Porter’s Potties confirms the requested service and any applicable quote, schedule, or order terms.
- Quotes are based on the information you provide and may change if the location, equipment count, rental period, access conditions, service frequency, disposal requirements, taxes, or other material facts change.
- Equipment availability is not guaranteed until confirmed by Porter’s Potties.
- Website calculators, recommendations, photographs, and descriptions are planning tools only and do not replace a confirmed quote or site-specific recommendation.
- Product appearance, color, configuration, and accessories may vary from website photographs based on inventory and service needs.
3. Delivery, placement, servicing, and pickup
You must provide a safe, legal, reasonably accessible location for delivery, service, and pickup. Porter’s Potties may decline or delay placement where conditions are unsafe, inaccessible, unlawful, or reasonably likely to damage equipment or property.
- Access routes should be reasonably clear of parked vehicles, locked gates, low branches, mud, soft ground, overhead hazards, animals, and other obstructions.
- You are responsible for identifying private utilities, irrigation, septic components, landscaping, weight limits, surface restrictions, or other site conditions that are not reasonably visible to our driver.
- If you direct placement in a particular location, you represent that you have authority to do so and that the placement location is suitable and lawful.
- Delivery and service times are estimates unless expressly guaranteed in writing. Traffic, weather, road closures, site conditions, emergencies, and other circumstances may affect timing.
4. Customer responsibilities
The customer is responsible for providing accurate information and using rented equipment safely and lawfully.
- Obtain any permits, property-owner approvals, venue approvals, or other permissions required for placement and use unless Porter’s Potties expressly agrees in writing to obtain them.
- Maintain reasonable access for scheduled service and pickup.
- Prevent unauthorized movement, vandalism, abuse, tampering, burning, tipping, or misuse of the equipment.
- Do not place hazardous, flammable, toxic, corrosive, medical, industrial, or prohibited waste into portable restrooms, hand-wash stations, holding tanks, or other equipment unless specifically approved in writing.
- Promptly notify Porter’s Potties of damage, spills, unsafe conditions, vandalism, theft, or service problems.
5. Equipment, ADA units, and sanitation services
All rental equipment remains the property of Porter’s Potties unless otherwise stated in writing. You may not sell, sublease, modify, relocate, disable, conceal, or encumber rented equipment without our permission.
Porter’s Potties may provide ADA-accessible restroom units. The customer remains responsible for determining whether a particular event, project, site, route, quantity, or placement must comply with accessibility, building, event, employment, or other legal requirements unless Porter’s Potties expressly agrees in writing to make that determination.
Service frequency and consumable replenishment are based on the confirmed rental arrangement. Unusually heavy use, vandalism, blocked access, or conditions outside the agreed service scope may require additional service or a revised schedule.
6. Pricing, taxes, fees, and payment
Pricing, deposits, service charges, taxes, payment timing, and other order-specific financial terms will be stated in the applicable quote, invoice, order confirmation, or rental agreement. The customer agrees to pay amounts that are properly due under those documents.
If additional work, trips, servicing, replacement, disposal, or other charges may apply, they will be governed by the accepted quote or other written agreement. Porter’s Potties does not rely on this website page to invent or impose undisclosed rental fees.
7. Changes, rescheduling, and cancellation
Please contact Porter’s Potties as soon as possible if you need to change equipment, delivery timing, service frequency, location, or pickup. Changes are subject to availability and may affect pricing.
Any deposit, cancellation, rescheduling, minimum-rental, or late-change terms that apply to a specific order will be stated in the applicable quote, invoice, order confirmation, or rental agreement. If no such charge is stated or separately agreed, these Terms do not create one by themselves.
8. Loss, theft, damage, and site conditions
To the extent permitted by law and the applicable rental agreement, the customer may be responsible for loss, theft, vandalism, unauthorized relocation, or damage to rental equipment while it is under the customer’s care, excluding normal wear and tear and damage caused by Porter’s Potties’ negligence or misconduct.
Porter’s Potties is not responsible for damage caused by undisclosed underground or site conditions, unsafe access, or a placement location specifically directed by the customer, except to the extent caused by our negligence or where liability cannot lawfully be limited.
9. Calls, texts, and email
If you provide a phone number or email address, you authorize Porter’s Potties to use it for service-related communications about your inquiry, quote, delivery, rental, pickup, payment, or customer support. Message and data rates may apply to text messages.
We do not treat submission of a quote form as consent to receive recurring promotional text messages. If we offer marketing texts or emails, any consent or unsubscribe terms required by law will be presented separately.
10. Website use and intellectual property
The website, including its design, text, graphics, logo presentation, photographs, code, and other content, is owned by Porter’s Potties or used with permission and is protected by applicable intellectual-property laws. You may use the website for personal or legitimate business purposes related to evaluating or requesting Porter’s Potties services.
You may not attempt to interfere with the website, bypass security, introduce malicious code, scrape the website at a rate that disrupts service, impersonate another person, submit fraudulent requests, or use the website for unlawful activity.
11. Third-party services and links
The website may link to or rely on third-party services such as hosting providers, payment processors, mapping services, analytics providers, or other vendors. Porter’s Potties is not responsible for third-party websites or services that we do not control.
12. Website information and warranties
We work to keep website information accurate, but availability, equipment details, service areas, schedules, pricing, and other information may change. Except for warranties expressly provided in a written rental agreement and to the fullest extent permitted by law, the website is provided “as is” and “as available.”
Nothing in these Terms excludes any warranty, right, or remedy that cannot lawfully be excluded under California or federal law.
13. Limitation of liability
To the fullest extent permitted by law, Porter’s Potties will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising solely from use of the website or from matters outside our reasonable control. Any order-specific liability allocation in a signed or accepted rental agreement controls for that order.
These limitations do not apply to liability that cannot legally be limited, and they do not excuse gross negligence, willful misconduct, fraud, or other conduct for which California law does not permit a contractual limitation.
14. Events outside reasonable control
Porter’s Potties is not responsible for delay or failure caused by events outside our reasonable control, including severe weather, wildfire, flood, road closure, government order, utility failure, equipment breakdown despite reasonable maintenance, labor disruption, supply interruption, accident, or emergency. We will make reasonable efforts to communicate and resume performance when practicable.
15. Responsibility for misuse and third-party claims
To the extent permitted by law, a customer agrees to be responsible for third-party claims, losses, or costs arising from the customer’s unlawful use, unauthorized relocation, intentional misuse of rental equipment, or material breach of these Terms, except to the extent caused by Porter’s Potties’ negligence or misconduct.
16. California law and disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Before filing a lawsuit, we encourage you to contact us so both sides have a reasonable opportunity to resolve the issue informally.
Unless applicable law requires otherwise or a separate written agreement states otherwise, legal proceedings relating to these Terms or Porter’s Potties services may be brought in a court of competent jurisdiction in California.
17. General terms
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect to the extent permitted by law. Our failure to enforce a provision is not a waiver of that provision. Headings are for convenience only.
We may update these Terms from time to time. The revised Terms will be posted here with a new “Last updated” date. Changes do not retroactively alter a separately signed or accepted rental agreement unless the parties agree otherwise.
